About us

Marshall Ray is an award-winning attorney who has experience in a variety of criminal and civil litigation matters. He regularly and successfully represents the accused in criminal cases in state and federal courts throughout New Mexico. His civil litigation experience includes labor and employment, construction, business litigation, civil rights, and appeals. Marshall has extensive experience in government relations, and he advises and consults with private and governmental organizations regarding their employee policies and practices. Additionally, he has conducted large-scale internal investigations. In 2014 he was named New Mexico’s Outstanding Young Lawyer of the Year by the State Bar of New Mexico. In 2015, he enjoyed national recognition from the National Association of State Workforce Agencies (NASWA), receiving the Legal Merit Award for distinguished service in the development and study of the Unemployment Insurance law of the United States. After graduating near the top of his class from the University of New Mexico School of Law, Marshall spent a year clerking for Federal District Court Judge James O. Browning. Following this prestigious appointment, Marshall joined a large regional law firm where he successfully handled a wide array of civil litigation and appellate matters in areas such as employment, civil rights, construction, civil RICO, Medicaid fraud, defamation, personal injury, insurance defense, lender liability, unfair trade practices, unfair insurance practices, foreclosure, and trademark infringement. In 2011, the Governor of New Mexico appointed Marshall as General Counsel to the New Mexico Department of Workforce Solutions (formerly called the New Mexico Department of Labor). Workforce Solutions is a highly visible government agency overseeing, among other things, human rights (anti-discrimination), wage and hour, and Unemployment Compensation.

Recent Cases

  • 17-CR-00370 (District of New Mexico): Mr. Ray represented one of four defendants who went to a jury trial in United States District Court on charges of conspiracy, money laundering, and violations of United States importation laws and the Indian Arts and Crafts Act. Mr. Ray vigorously represented his client, and at the close of a complex jury trial in Federal Court, spearheaded the dismissal of all charges for all defendants.
  • 18-cr-1966 (District of New Mexico): Mr. Ray was part of a trial and appeal team representing government contractors facing federal indictment with allegations of conspiracy and fraud in relation to government contracts valued at millions of dollars. The Defense teams brought successful post-trial motions leading the district court to grant judgments of acquittal on substantive charges and reversal of conviction on conspiracy charges, which were upheld at the United States Court of Appeals for the Tenth Circuit. On Remand Mr. Ray was able to negotiate dismissal of all criminal charges.
  • 20-CR-1571 (District of New Mexico): Representing a client facing mandatory prison time of 15 years, up to Life under the Armed Career Criminals Act, Mr. Ray obtained complete dismissal after successfully moving to suppress evidence obtained in violation of his client’s constitutional rights. In a published opinion, the district court agreed that police officers violated the client’s right to be free from unreasonable search and seizure under the Fourth Amendment to the United States Constitution. United States v. Purvis, 663 F. Supp. 3d 1233, 1260 (D.N.M. 2023).
  • D-202-CR-2019-02643 (New Mexico State Court): Charged with First Degree Murder, Mr. Ray’s client asserted self-defense at trial. The jury acquitted Mr. Ray’s client of First Degree Murder and Second Degree Murder, while all other homicide-related charges were subsequently dismissed. Mr. Ray’s client was convicted solely of a petty misdemeanor.
  • D-101-CV-2022-00593 (New Mexico State Court): After the N.M. Counseling and Therapy Practice Board permanently suspended the license of a long-time behavioral health services provider in violation of its own regulations, Mr. Ray successfully appealed on behalf of his client, obtaining a judicial finding that his client’s constitutional rights had been violating, and an order for immediate reinstatement.
  • D-202-CV-2021-02755: Mr. Ray’s client faced accusations of fraud in obtaining Pandemic Unemployment Assistance benefits during the COVID-19 Pandemic. Mr. Ray appealed the findings of the New Mexico Department of Workforce Solutions in State Court and obtained a ruling fully exonerating his client of any fraud findings.
  • A-1-CA-37577 (New Mexico Court of Appeals): In a published opinion, the New Mexico Court of Appeals held that N.M. Department of Game & Fish wrongfully withheld publicrecords in violation of the New Mexico Public Records Act. See Dunn v. New Mexico Dept. of Game & Fish, 2020-NMCA-026, 464 P.3d 129.
  • M-45-VM-2022-00324: Mr. Ray’s client was accused of battery on a household member. Mr. Ray aggressively represented his client and, after a jury trial, obtained complete dismissal.
  • D-202-CV-2016-05572: Mr. Ray’s client was seriously injured when a police officer pursued him on foot and, without announcing himself, tackled the client. Mr. Ray and his co-counsel successfully engaged in complex litigation, culminating in a jury trial in which a New Mexico Jury found the officer liable and awarded damages for the client’s injuries.
  • 16-cr-3068 (United States District Court N.M.): Mr. Ray’s client faced a federal indictment for aggravated sexual assault in Indian Country. Mr. Ray and his co-counsel tried the case to a jury and obtained a complete acquittal.
